What Should You Look for When Hiring an Injury Attorney?

General educational information, not legal advice. Review scope: federal rules and Texas/Wisconsin examples only, where stated—not a review of every state’s law. Applicable law, coverage, and deadlines depend on the jurisdiction and facts.

Verify qualifications and the proposed relationship

Confirm the lawyer's license through the relevant state licensing authority. Ask about experience with the issues your matter actually presents, such as commercial vehicles, serious injury, disputed insurance or multiple defendants. An impressive result in another matter does not predict your outcome.

Find out who would be responsible for your case, whether another firm may participate, and what work the agreement covers. Do not assume that an initial conversation means the lawyer has agreed to represent you or protect a deadline.

Ask how communication will work

Discuss how you can ask questions, who responds, and how significant decisions will be explained. Ask what information the firm needs from you. For example, Texas's professional rules require reasonable client communication and explanation sufficient for informed decisions.

Clear expectations are more useful than a promise that a lawyer will always be available immediately. You should understand how urgent issues will be handled and what updates to expect.

Read the fee and expense terms

Ask how the fee is calculated, which expenses are separate, and what happens if there is no recovery. Ask whether expenses are deducted before or after a percentage fee and whether other deductions could affect the net amount. Texas, for example, requires specified terms in a written contingent-fee agreement. Other jurisdictions' requirements must be checked separately.

Request an explanation of anything unclear before signing. Ask about the process and practical next steps, not a guaranteed settlement amount.

Make a considered choice without ignoring deadlines

Compare clarity, relevant experience, scope and cost rather than advertising claims alone. Obtain prompt advice about time limits even if you are still deciding whom to retain. Keep copies of any signed agreement and provide accurate records when a representation begins.
